Indiana’s attorney general announced Thursday that he is investigating whether the Indiana doctor who performed an abortion on a 10-year-old Ohio rape victim complied with court regulations. State obliging doctors to report terminations of pregnancy and possible cases of child abuse. Indiana Attorney General Todd Rokita warned Dr Caitlin Bernard that she could face ‘criminal charges and licensing implications’ if she does not submit required reports on time in a statement posted online with a letter to the Governor of Indiana.
Rokita went on to say that he would also check to see if the doctor violated federal patient confidentiality regulations. The Indianapolis Star newspaper reported that it had obtained documents through a public records request showing that Bernard had in fact complied with disclosure requirements in a form she filed with the Department of Health. of Indiana and the Indiana Department of Children’s Services, however, making the warning sound like a hollow threat.

In keeping with the law, as well as her medical and ethical training as a doctor, Kathleen Delaney, Bernard’s attorney, was also quoted by the newspaper as saying her client took all proper and proper actions. The Indianapolis Star first reported the story of the 10-year-old girl from Ohio who was raped and fled to Indiana to have an abortion because of a state law in Ohio which prohibited the procedure at six weeks of pregnancy, when many women do not even know that they are pregnant, without exception in the event of rape or incest.
When the Ohio girl left her home state to terminate her pregnancy, she was three days past Ohio’s six-week limit. The Roe v. Wade, which established a constitutional right to abortion to end a pregnancy, was struck down by the Supreme Court on June 24. Hours later, Ohio’s ban went into effect.
